Conservation Commission Vacancy

The Montpelier City Council is seeking individuals interested in filling an Alternate seat on the City's Conservation Commission; said position is a one-year term which will expire in May, 2009. Letters of interest and/or resumes should be submitted to the Office of the City Manager, City Hall - 39 Main Street, Montpelier, on or by noon on Friday, May 23rd. The City Council will make these appointments at their Wednesday, May 28th, City Council Meeting; applicants are encouraged to attend. MONTPELIER NOTICE
ORDINANCE AMENDMENT

To amend the City of Montpelier Code of Ordinances, Chapter 10, Motor Vehicles and Traffic as follows:

Sec. 10-501. ONE-WAY STREETS.
In accordance with Section 10-500 of this Article, when properly signposted (sic), all vehicular traffic shall pass on the following streets only in the direction indicated and not otherwise:

NEW SUB-SECTION

[(h) Park Avenue - southerly, between Loomis Street and Hubbard Street seasonally during the school calendar year, as determined annually by the Montpelier School Board.

Sec. 10-717. LIMITED PARKING.

SUB-SECTION to be DELETED:
(x) Park Avenue. For the establishment of a loading and unloading zone, parking is restricted on the west side of Park Avenue from the driveway near the southeast corner of the school to a point 40 feet northerly.

SUB-SECTION to be REVISED:
(aa) Park Avenue. For the establishment of a student loading and unloading zone and a visitor parking area adjacent to the Union Elementary School, parking is restricted on weekdays during the hours of 8:00 [7:30] A.M. to 3:00 P.M.[9:00 A.M. and 2:30 P.M. to 3:30 P.M.}, during the school’s calendar year (Sept. 1 - June 15) [as determined annually by the Montpelier School Board] on the west [south] side of Park Avenue from a point located 75 [20] feet northerly [easterly] of the Hubbard [Loomis] Street curb line intersection and extending northerly [southerly for] a distance of 180 [252] feet to a point located 25 [10] feet northerly of the Union School driveway. [Said loading and unloading zone is further limited to a parking duration of no more than five minutes, and no vehicle may be left unattended during the loading and unloading zone time restriction. A maximum parking duration of two hours is established for all other time periods outside of the loading and unloading restriction period. Any vehicLe found to be in violation of these restrictions may be removed from the site under authority of the Police Department and the registered owner of said motor vehicle may be subject to costs, including towing and storage.]

MONTPELIER NOTICE
PROPERTY TAX INSTALLMENT DUE DATE

The FOURTH INSTALLMENT of Real Estate and Personal Property Tax is due on May 15, 2008.

Payments by mail must be postmarked at a United States Post Office on or before May 15, 2008. An 8% penalty will be added to the unpaid portion of each delinquent installment. If the installment remains unpaid, interest will be added one month from the due date, and for the subsequent two months at the rate of one (1%) percent per month and thereafter interest will be charged at the rate of 1-1/2% per month on delinquent taxes.

As per Title 12, Section 7, Application of Payment on Delinquent Taxes. Payment made on the account of delinquent taxpayers shall be applied: first, to all outstanding personal property taxes for which said delinquent taxpayer is responsible; second, to real estate taxes for which said delinquent taxpayer is responsible. Provided, however, that the holder of a mortgage or other lien upon real or personal property of a taxpayer may make payment on said taxpayer's account and may specify that such payment be applied on the tax assessed against the property covered by such mortgage or lien. Any taxes paid shall be applied to penalty, interest and oldest outstanding delinquency in that order first.

Signboard & Sidewalk Display Guidelines

Chapter 15, Article 7, §701.D. of the Montpelier City Ordinance states, in part:

Placement of any sign or display within the public right of way requires approval by the Director of Public Works acting as Streets Commissioner. These signs include freestanding signboards or menu boards, signs, vending machines, displays of merchandise, etc., placed within the public right of way or upon public sidewalks.

NOTICE TO BUILDING OWNERS
SPRINKLER TAX CREDIT

Now is the time for building owners in Montpelier to apply for their Sprinkler Tax Credit. The City of Montpelier has decided that fire sprinklers are the first line of defense against uncontrolled structure fires. Fire sprinklers are the best way to protect lives, protect property, and to preserve community resources. The City has taken a two fold approach, requiring fire sprinkler systems in new construction and providing an incentive for property owners. This was the long term plan and now the major components are in place.

The building code changes were made in 2003. However, the incentive program took several years to accomplish as it required a City Charter change to be approved by the voters and then by the Vermont Legislature. In 2007 the Legislature gave its approval and in February 2008 the City adopted the resolution providing a tax benefit on buildings protected by sprinklers. The benefit is 10% off the municipal taxes on a building fully protected by a sprinkler system. There is a 5% benefit for partial sprinkler protection. The benefit for a building is capped at $2,500. The Fire Chief determines which buildings would qualify for the benefit.

The City recognizes that the benefit does not pay for a system. It is however a way of thanking building owners for their effort to protect lives and property and help maintain the character of the community.

Owners of buildings, including condominium ownership arrangements, in buildings that have fire sprinkler systems can apply at this time. There is a June 1, 2008 deadline for a credit during the fiscal year starting July 1, 2008. FLOOD INFORMATION

The City of Montpelier currently uses the flood monitoring page of its website to keep area residents informed on water levels and potential ice jams in the Winooski and North Branch Rivers.

If there is a flood situation, the flood monitoring page will be the place to find the lates emergency information and safetly updates from the Police Department, City Manager, and FEMA.

Free Capital Shuttle

The Capital Shuttle operated through Green Mountain Transit Agency will be starting on January 8, 2008 for the start of the new Legislative season.   The shuttle service operates free of charge Tuesday through Friday within the downtown Montpelier area.   The National Life Building, North Entrance Lobby will be served every 10 minutes starting at 7:25 am with the last stop at 5:46 pm.  Monday service will be added the week of April 24th.

NOTICE TO PROPERTY & BUSINESS OWNERS, RESIDENTS & SNOW REMOVAL CONTRACTORS
  • The City of Montpelier Code of Ordinances, Article V, Section 3-506, “Placing Ice or Snow into Public Way”, clearly states: “No person, partnership, or corporation shall throw, shovel, propel, deposit, or cause to be thrown, shoveled, propelled, or deposited, snow or ice from private property into the streets or public sidewalks.”

    Additionally, be advised that Section 3-507 allows the City to impose fines of up to fifty dollars ($50.00) per incident, and to recover expenses and costs incurred by the City for removal and cleanup.
  • City residents who have installed or placed a basketball hoop and pole or any other sports equipment in the City’s right-of-way are hereby advised that these items are subject to removal without notice. The City will not be liable for any damage that occurs to this equipment during snowplowing or other winter maintenance operations.
  • Awnings that hang over the City sidewalk must be retracted during snowplowing and snow removal operations. The City will not be liable for damages to awnings caused by our equipment.
  • The Department of Public Works has several very simple guidelines for those business owners who use Sidewalk Display Signboards. Please call the Public Works Office for a copy of these guidelines.

NOTICE OF AMENDMENT TO CITY’S CODE OF ORDINANCES
PARKING AND PARKING METER ZONES

To amend the City of Montpelier Code of Ordinances, Chapter 10, MOTOR VEHICLES AND TRAFFIC, Article VII. PARKING AND PARKING METER ZONES. Amended language and updated fees for parking violations are incorporated into the following sections (a brief overview of the changes are as follows):

Sec. 10-718, SPECIAL DISABLED PERSON PARKING
Fine for violation changed from $25.00 to $100.00

Sec. 10-719, PARKING VIOLATION PENALTY
Time violation changed from $6.00 to $10.00 with a penalty of $6.00 added if payment is not received within ten days.
Other ordinance violations regulating, controlling, prohibiting or limiting the parking of motor vehicles will be changed from $10.00 to $15.00 with a penalty of $8.00 added if payment is not received within ten days.
Hydrant area violations will be fined $50.00

Sec. 10-722, FEES
Cost of Motor Vehicle removal was changed from $35.00 to a not to exceed fee of $100.00 and storage cost changed from $2.00 per day to a not to exceed fee of $12.00 per day.


The Montpelier City Council approved the above ordinance amendment(s) at its final reading on February 20th, 2008. Effective date is six days after publication; published March 24th, 2008.

  • Whether a property is in or out of the Special Flood Hazard Area (SFHA) as shown on the current Flood Insurance Rate Map (FIRM) of the City.
  • Additional flood insurance data for a site, such as the FIRM zone and the base flood elevation or depth, if shown on the FIRM,
  • We have a handout on the flood insurance purchase requirement that can help people who need a mortgage or loan for a property in the SFHA.
  • We have copies of completed FEMA Elevation Certificates for buildings built in the floodplain since 1991.

The City Council approved a 5% increase in Water and Sewer rates that was effective July 1, 2007.

For this quarter, the rates are as follows:

WATER:
First 50,000 gallons $ 6.94 per 1,000 gallons
Next 200,000 gallons $ 7.37 per 1,000 gallons
More than 250,000 gallons $11.95 per 1,000 gallons

Quarterly “ready to serve” water fee remains at $19.50

SEWER:
$7.83 per 1,000 gallons of water used
Quarterly “ready to serve” sewer fee remains at $24.50
Customers that are sewer only “flat rate” users are charged $143.12 quarterly.

To amend the City of Montpelier Code of Ordinance, Chapter 10, Motor Vehicles and Traffic, Article VII, Section 10-716. PARKING PROHIBITED, with the following new sub-section:
(ppp) Summer Street - Parking is prohibited on both sides of Summer Street beginning at the point of intersection with Spring Street and extending easterly for a distance of one hundred ten feet (110’).

Notice to Property Owners & Public Officials
New Floodplain Maps from FEMA

July 6, 2007

Dear Property Owners and Public Officials:

FEMA has redrawn the flood hazard maps that are used for flood insurance rates for most of Montpelier. The changes are extensive. Many previously excluded properties are now included in one or more flood hazard areas. This may affect your insurance premiums, mortgage financing and other property ownership finances. FEMA is holding two public meetings in Washington County as part of the process to adopt the new Digital Flood Insurance Maps and Flood Insurance Studies. At the meetings, FEMA will provide an overview of the new maps they propose and take your comments. This is the only time that FEMA will be taking public comments on these important changes.

The only Community meeting planned by the Federal Emergency Management Agency (FEMA) to take your comments on the new proposed flood insurance rate maps is on July 25, 2007 at 1:00 PM and 7:00 PM at the Waterbury State Office Complex in the Skylight Conference Room on the first floor of the Connector Building in the Agency of Human Services. We experienced this year how prone Montpelier is to flooding and how important it is to be prepared and have flood insurance.

FEMA is not providing any notice to any affected property owner. If you wish to determine if your property is affected, please come to the City Planning and Community Development Office in the ground level at City Hall to view the maps. The Office is open Monday through Friday except holidays from 8:00 AM to 4:00 PM.

If your property is in the new floodplain hazard designated area, you should contact your insurance agent to discuss what steps to take and to be prepared for changes in your insurance rates. FEMA will not be completing this new map process until spring of 2008. When FEMA adopts the new maps, then the new insurance rates will apply to your property. Prior to then however you may want to make plans with your insurer so that you have continuous coverage. If you have federal or federally related financing for your property, you should contact your lender to discuss any changes to the flood hazard area designation of your property. If your property designation does not change from the current map to the new map, then your insurance and financing should not be affected, but you may want to verify that with your insurer and lender.

The City will also be required to adopt FEMA prescribed ordinances to conform Montpelier Zoning regarding flood hazard areas to FEMA requirements. This needs to occur before the end of 2008.

Notice to Customers of the Montpelier Water System

The Montpelier Water System, a public water system under the laws of the State of Vermont, was reissued a temporary Operating Permit on January 21, 2005. The Secretary of the Agency of Natural Resources found that such issuance will not unreasonably contribute to a public health risk, although the Montpelier Water Systems does not presently comply with the provisions of with certain requirements of the Federal Safe Drinking Water Act and applicable state statutes and rules. The nature and extent of the non-compliance are as follows:
  1. Customers Receiving Untreated Surface Water: The City of Montpelier is actively working to complete a plan of action for those households in the Town of Berlin who are using untreated water against our advice.
The following items were found deficient during the September 8, 2004 Sanitary Survey, but have since been corrected:
  • Bacteriological Sampling Plan Update: The City's coliform sampling system has been updated to reflect changes made to the system since the Division last approved this plan. The updated sampling plan was approved by the State Water Supply division in June 2005.
  • Cross connection Controls: The required cross connection control device was installed in January 2005 and the record drawing and changes to procedure were approved by the State on February 16, 2005.
  • Inadequate Isolation Distances Between Water & Sewer Lines: It has been verified that these lines are no longer in conflict.
  • Storage Vent Sanitary Seal: The damaged vent seal was repaired in January 2005 using water-safe construction sealant provided by the tank manufacturer.
  • Backflow Protection Device Testing: The five devices located at the water Treatment Facility were tested on February 28, 2005, and are now on an annual inspection schedule.

MONTPELIER DISTRICT HEATING TO GET UPDATED ASSESSMENT
SEEKS COMMUNITY ASSISTANCE

Montpelier’s plans for a downtown district heating system are getting a fresh look this summer as the Biomass Energy Resource Center (BERC) revisits the assumptions about project costs and existing heating systems in Montpelier’s buildings. BERC is seeking the public’s assistance to make certain its information about downtown buildings is accurate.

A district energy system uses a central plant to provide thermal energy in the form of hot water or steam delivered via underground pipes to multiple buildings. This replaces the need for individual, building-based boilers and furnaces. District energy systems operate in St. Paul, Minnesota, New York City and dozens of cities and communities across the country. In Montpelier, the plan has been to extend the wood-fired state-complex system to provide hot water to heat part or all of the neighboring downtown commercial area.

BERC’s Executive Director Tim Maker notes, “Five years ago we initiated a feasibility assessment based on an inventory of the heating systems in downtown buildings, the costs of fuel and assumptions about the capacity of the State’s boiler system. A lot has changed since then – fuel costs have more than doubled, the State is moving ahead with plans for a new boiler system and many downtown building have changed their heating systems. It is clearly time to revisit our assumptions about this opportunity.”

Step one has been updating the information about the heating systems of buildings in Montpelier’s downtown. Project Manager Nancy Wasserman has been compiling this information over the past few months. With the City’s assistance, the buildings have all been mapped by fuel source, type of heat distribution and age of the heating system.

BERC is seeking the community’s assistance in making certain the information is accurate. Copies of the maps will be on display during the week of June 19 in the Coffee Corner window. They will also be available for review from June 19-30 at Montpelier City Hall, the Kellogg-Hubbard Library and at BERC’s offices at 50 State Street as well as on the City’s web site. Information about how to correct the data will be available at each display site.

Once the downtown data is accurate, BERC’s district energy engineer will prepare an updated design and preliminary implementation plan for the downtown pipe loops. Revised cost assessments will then be prepared. BERC expects to present the results of its assessment to the community at a public meeting in September. “When BERC and the City looked at this a few years ago,” comments Wasserman, “the economics were OK if the system could secure enough customers. The combination of substantially higher fuel prices and the State’s plans for an enhanced boiler plant may make the system a lot more financially attractive to building owners. This updated assessment will let us get a sense of how much better.”

Both the Montpelier and City-State Master Plans support developing a combined district energy system. Beyond the finances, the interest in district heating for the Montpelier community has been propelled by a number of benefits. When connected to the State’s boiler central boiler plant, downtown buildings will be able to be heated through much of the winter with wood chips. This would also improve air emissions by replacing lots of small heating plants with one large professionally managed plant. A downtown district energy system will reduce reliance on imported fossil fuels, insure energy security, build the local economy, reduce greenhouse gases, enhance forest health by providing a market for low-grade wood, and dramatically cut the number of oil and propane tanks in the Winooski River floodplain. In 2003, the citizens of Montpelier authorized a $250,000 bond for the City's share of the development of the community system.

The Biomass Energy Resource Center is an independent, nonprofit organization established by public and private sector leaders to assist in the development of biomass energy projects across the United States. Based in Montpelier, BERC provides a wide range of technical assistance in assessing, developing and implementing wood energy projects.

The City of Montpelier's Americorps' Neighbor to Neighbor Program is working to coordinate the donation of firewood for needy Montpelier families. The drop-off / pickup site for Montpelier is at the Stump Dump, located on City Dump Road off of Elm Street. All are welcome to donate firewood, but please do not take firewood unless you expect to have difficulty affording to pay for firewood on your own. For more information or to arrange a pickup of donated firewood, contact the Montpelier Dept of Public Works, 223-9508.

Ordinance Amendment

To amend the City of Montpelier Code of Ordinances, Chapter 10, MOTOR VEHICLES AND TRAFFIC, Article VIII, Parking and Parking Meter Zones, Sec. 10-716. PARKING PROHIBITED as follows:

Sec. 10-716. PARKING PROHIBITED.
     (eee) Spring Street - Parking is prohibited on the east side of Spring Street from Elm Street to a point one hundred seventy-three (173) feet southerly and from a point two hundred thirty-six (236) feet from Elm Street and extending southerly to and including Keck Circle and from Elm Street extending northerly for a distance of sixty (60) feet, and on the west side commencing at a point two hundred thirty-five feet from Elm Street and extending southerly to and including Keck Circle and from Elm Street extending northerly for a distance of eighty-five (85) feet to the driveway serving 162 Elm Street.
The City Council passed the above ordinance amendment at their November 16th Special City Council Meeting. This will become effective six days after publication. Published 12/05/2005.

Request For Proposals
RIVER ST SEWER MAIN UPGRADE

The City of Montpelier is seeking bids from qualified contractors for a Sewer Main Upgrade along River Street in Montpelier, VT. The project consists of:
  • approximately 470LF of 18” Sewer Main
  • 6 precast concrete manholes
  • 7 service connections with cleanouts
  • 370LF of granite curbing
  • 240SY of concrete sidewalk and pavement restoration
Work is anticipated to begin in early June. Plans can be viewed at either the Montpelier Public Works office at 39 Main Street, City Hall or at Works in Progress, Inc. 20 Farrell Street, South Burlington, VT.

Bids will be received at the City Manager’s Office until 10:00am on Wednesday, May 28, 2008
. Complete contract documents can be purchased from the City of Montpelier Public Works office for $25 per set.

CONSTRUCTION INSPECTION SERVICES

The City of Montpelier is inviting interested parties to submit a Statement of Qualifications for consultant services to provide resident engineer, materials testing and project administration services during the construction phase, as described in the Request for Qualifications and the Scope of Services for Construction Inspection, for the FEGC 028-3(34) project. This project will provide a roundabout at intersection of US 2 and US 302, two signalized railroad crossings, and related features on River Street within the city of Montpelier.

CITY-WIDE REAPPRAISAL

The City of Montpelier is requesting proposals from qualified, Vermont Division of Property Valuation and Review approved appraisal firms to work with the Montpelier Assessor to complete a City-wide reappraisal.

The selected contractor will be responsible for a thorough analysis of local real estate market conditions and review of the existing Computer Assisted Mass Appraisal (CAMA) data leading to the development of computer models for estimating the fair market value of all taxable real property in Montpelier.

Proposals are due by 2:00 PM on May 15, 2008 and will be opened and read at that time. Three (3) complete proposals shall be submitted in a sealed envelope, clearly marked MONTPELIER REAPPRAISAL and addressed to: Montpelier City Assessor, 39 Main Street, Montpelier, VT 05602.
