The Montpelier City Council will convene a public hearing on Wednesday, August 30, 2006 in accordance with 24 VSA §4442 to consider alterations to the Council’s July 2006 proposed revisions, which altered the Planning Commission’s March 22, 2006 proposed revisions to the City of Montpelier Zoning and Subdivision Regulations and Zoning Map. The proposed revisions will affect all lands within the City of Montpelier. The unaltered portions of the Council’s July 2006 revisions remain as originally proposed. A public hearing was convened on Wednesday, April 12, 2006, continued to April 26, 2006 and closed in accordance with 24 VSA §4442 to consider a variety of major amendments to the City of Montpelier Zoning and Subdivision Regulations and Zoning Map. The Council continued deliberations on May 17, 2006 and will continue them still on May 24 and May 31, 2006. The purpose of the amendments is to comply with the revisions to 24 VSA Chapter 117; to implement provisions of the Montpelier Municipal Plan; to clarify unclear procedural provisions; to promote traditional patterns of neighborhood development; and to protect sensitive areas, including ridgelines and hillsides. In addition, two revisions are proposed to the Zoning Map: (1) replacement of the interim zoning provisions relating to the area known as “Sabin’s Pasture” with revised permanent zoning along Barre Street and the adjoining land owned by Vermont College; and (2) re-zoning of the Sabin Street neighborhood from HDR to MDR. The proposed revisions will affect all lands within the City of Montpelier. A summary of the proposed changes is below.
Amendments in response the revisions to 24 VSA Chapter 117:
- Accessory apartment requirements modified;
- Public notice procedures updated;
- Permit exemptions clarified;
- Non-conforming structures and uses clarified; and
- Various minor adjustments.

Other Amendments:
- Lighting standards expanded;
- Subdivision and planned development application requirements consolidated into a matrix;
- Standards created to encourage mixed uses in Planned Developments;
- Mandatory clustering of planned developments in the LDR district;
- Interim zoning provision and the underlying zoning districts replaced with a combination of Low Density Residential (LDR), Medium Density Residential (MDR), and High Density Residential (HDR) districts on land commonly known as “Sabin’s Pasture” along Barre Street, adjoining land owned by Vermont College, and adjacent neighborhoods. The proposed LDR district coincides with the upper pasture area and the HDR district is comprised of a 300-foot deep area paralleling Barre Street and Sabin Street;
- Lot sizes and setbacks reduced in LDR, MDR, and HDR districts;
- Various adjustments in the Use Table 207;
- Some definitions updated or added;
- Graphics to illustrate concepts included; and
- Various minor adjustments.

The Montpelier Planning Commission held a public meeting to solicit feedback on revised amendments proposed to the City of Montpelier Zoning and Subdivision Regulations and Zoning Map. The purpose of the amendments is to comply with the revisions to 24 VSA Chapter 117; to implement provisions of the Montpelier Municipal Plan; to clarify unclear procedural provisions; to promote traditional patterns of neighborhood development; and to protect environmentally and visually sensitive areas. In addition, the Zoning Map is proposed to be revised as follows: replacement of the interim zoning provisions relating to the area known as “Sabin’s Pasture” with revised permanent zoning along Barre Street and the adjoining land owned by Vermont College consisting of HDR and LDR Districts. The proposed revisions will affect all lands within the City of Montpelier.

The Montpelier Planning Commission held a public forum to discuss the proposed amendments to the Montpelier Zoning and Subdivision Regulations and Zoning Map on Tuesday, January 17, 2006, 7:00 p.m., in the Lost Nation Theater space on the upper floor of City Hall. The Capital Community Justice Center facilitated the meeting.
The proposed amendments were available for review at the Montpelier City Clerk's Office, the Montpelier Department of Planning and Community Development, and the Kellogg-Hubbard Library during regular business hours. To Extend Interim Zoning One Year
Wednesday, May 25, 2005, 7:30 p.m., City Hall
Notice is hereby given to the residents and voters of the City of Montpelier that the City Council [held] a public hearing on Wednesday, May 25, 2005, 7:30 p.m., at the Montpelier City Hall to receive public comment and to consider extending for one additional year the Interim Restricted Development District Interim Zoning Regulations, in accordance with 24 V.S.A. §4415(f), that currently overlays the existing boundaries of the General Business, Low Density and Medium Density Residential Districts. The interim zoning regulations proposed to be extended are set forth in their entirety below. The Interim Restricted Development District map referred to below is available for review at the Office of the City Clerk, the Department of Planning & Community Development, and on the City’s Web site at http://www.montpelier-vt.org/docs.
Interim Zoning Regulations Establishing an
Interim restricted development District
1. There is hereby established an Interim Restricted Development zoning district which is shown on a plan entitled, "Interim Restricted Development District," dated May 12, 2003. This plan is incorporated into this interim zoning regulation by reference.
2. No land development shall occur in the Interim Restricted Development District except as provided for in accordance with 24 V.S.A. §4410(d).
3. These interim zoning regulations shall not repeal or alter any existing regulations of the City of Montpelier. These regulations establish requirements and restrictions which are in addition to those contained in any other regulations of the City.

The Montpelier Planning Commission convened a public hearing to consider proposed amendments to the Montpelier Zoning and Subdivision Regulations, which were created by a City Council subcommittee to replace the current and interim zoning provisions currently affecting lands commonly known as "Sabin's Pasture" along Barre Street and the adjoining land owned by Vermont College. The proposed zoning and map amendment would apply new T1, T4A, and T4B districts to the lands currently zoned General Business (GB), High Density Residential (HDR), Medium Density Residential (MDR), and Low Density Residential (LDR).
Adapted from the SmartCode© model, the proposed amendment is intended to be a stand-alone code applied to this area, but in conjuction with the current Montpelier Zoning and Subdivision Regulations. Below is an outline of its contents:
